6. Orders and formation of the contract

Where payment by instalments is offered, you remain responsible for paying the full agreed price. An instalment plan is a payment arrangement and does not make the programme a monthly subscription unless expressly stated.
If an instalment payment fails, we may suspend your access while the payment remains outstanding.
8. Digital content and immediate access
Some products provide immediate access to digital content, including videos, downloads, templates, recordings or online learning materials.
Where you request immediate access during the statutory cancellation period, you may be asked at checkout to:
- expressly consent to the digital content being supplied immediately
- acknowledge that your right to cancel may be lost once supply of the digital content begins
We will only rely on the loss of cancellation rights where the legally required consent and acknowledgement have been obtained.
Digital content must be as described, of satisfactory quality and fit for any particular purpose made known to us, subject to applicable consumer law.
9. Services and live programmes
Where you purchase a service, workshop, live programme or other service-based offer, you normally have the right to cancel within 14 days of entering into the contract.
You may ask us to begin providing the service during this cancellation period.
If you cancel after the service has begun at your request, we may deduct a reasonable amount for the part of the service already provided.
If the service has been fully performed within the cancellation period, your right to cancel may be lost where you expressly requested early performance and acknowledged that consequence.

10. Cancellation and refunds
Your cancellation and refund rights depend on whether you purchased:

- a service
- a live event or programme
- a membership or subscription
- another type of product

Nothing in that policy or these Terms limits your statutory rights where content or services are faulty, misdescribed or not supplied with reasonable care and skill.

11. Programme access
Your purchase grants you a personal, limited, non-exclusive and non-transferable right to access and use the programme or resource for your own individual purposes.
Unless otherwise stated on the product page:
- access is for one person only
- login details must not be shared
- materials must not be uploaded to shared drives or public platforms
- access may not be resold, transferred or sublicensed
- materials may not be used to create or deliver a competing product, programme or service
Where an access period is specified, you are responsible for downloading any permitted materials before that period ends.
We are not responsible for loss of access caused by your failure to use or download materials within the stated period.
12. Intellectual property
All website content and programme materials, including text, frameworks, models, methods, videos, audio, workbooks, graphics, templates, branding and downloads, are owned by or licensed to Now She Builds Ltd.
They are protected by copyright, trademark and other intellectual property laws.
You must not, without our prior written permission:

You retain ownership of any original work you create while participating in a programme.
13. Acceptable behaviour
When participating in a live event, group programme, community or interactive service, you agree to communicate respectfully and not:
- harass, threaten or abuse another person
- post discriminatory, defamatory, unlawful or offensive material
- share another participant’s confidential or personal information
- promote unrelated products or services without permission
- disrupt sessions or misuse the platform
- infringe another person’s rights
We may remove content, restrict participation or suspend access where these standards are seriously or repeatedly breached.
No refund will be due where access is terminated because of a material breach of these Terms, except where required by law.
14. Confidentiality and group participation
Group programmes may involve participants sharing personal, professional or commercially sensitive information.
You agree not to disclose another participant’s private information outside the programme without their permission.
However, we cannot guarantee that every participant will comply with this obligation. You should therefore exercise care when deciding what information to share in a group environment.

Purchases made through this website are contracts between you and Now She Builds Ltd, not between you and Shopify.
Shopify provides the technical ecommerce platform but is not responsible for delivering our programmes or services or resolving disputes concerning your purchase from us.
18. Website availability
We aim to keep the website and purchased digital services available, but we cannot guarantee uninterrupted or error-free access.
Access may occasionally be interrupted for maintenance, security, technical problems or matters outside our reasonable control.
Where a material interruption affects a paid programme, we will take reasonable steps to restore access or provide an appropriate alternative.
19. Viruses and security
You must not knowingly introduce viruses, malware or other harmful material to our website or attempt to gain unauthorised access to our website, systems, customer accounts or hosting infrastructure.
You are responsible for protecting your own devices, software and internet connection.
20. Limitation of liability
We do not exclude or limit liability where it would be unlawful to do so.
This includes liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- breach of statutory consumer rights
- any other liability that cannot legally be excluded
Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the contract was made.
Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity, contracts or goodwill.
Where you purchase primarily for business purposes, our total liability arising from the relevant purchase will, to the fullest extent permitted by law, be limited to the amount you paid for that product or service.
Nothing in these Terms removes your responsibility for your own business, career, financial or personal decisions.
21. Events outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including serious illness, internet or platform failure, industrial action, natural disaster, government action, epidemic, war or disruption to essential services.
Where such an event materially affects a paid service, we will contact you where reasonably possible and may reschedule, extend access or offer an alternative form of delivery.
Your statutory rights will not be affected.
22. Suspending or terminating access
We may suspend or terminate access where you:
- fail to pay an amount due
- share your account or programme materials without permission
- seriously or repeatedly breach these Terms
- behave unlawfully or abusively
- compromise the security or integrity of our services
Where appropriate, we will provide notice and an opportunity to remedy the breach.
Termination does not affect rights or obligations that arose before termination, including outstanding payment obligations and intellectual property protections.

Because our store is hosted by Shopify, information needed to operate the website, process transactions and provide customer services may also be processed by Shopify and other service providers.
